What is the difference between compensation and ticket refund?

Since 2004, passengers have been protected in the event of flight irregularities by the EU Passenger Rights Regulation 261/2004. Problems such as flight cancellations and delays regularly cause inconvenience to passengers. Therefore, if the airline caused the flight problem, affected travelers are entitled to compensation. Passengers are entitled to this so-called compensation payment in the event of delays of more than 3 hours, last-minute cancellations, overbooked flights and missed connecting flights. Compensation can be seen as a kind of compensation for passengers.

The ticket refund, on the other hand, is the refund of the ticket price to the passenger, as the airline has not provided its service. Travellers whose flight is cancelled without replacement and if the flight times are extremely different and they no longer want to travel at the new time are entitled to a ticket refund.

What am I entitled to if my flight is cancelled due to Corona?

If your flight with TAP Air Portugal is cancelled because it cannot be operated due to applicable Corona regulations, you are not entitled to compensation. However, the airline must reimburse you for the ticket costs within 7 days or, alternatively, enable alternative transport or rebooking to a later date. This is provided for in Article 8 of the EU Air Passenger Rights Regulation. If you have used a replacement flight or accepted a rebooking, you are no longer entitled to a ticket refund for the cancelled flight.

When can I get compensation from TAP Air Portugal for a flight cancellation?

If the airline informs you of the cancellation of your flight less than 14 days before departure, you may be entitled to compensation. Whether you wanted to fly for private or business reasons, the flight was booked individually or as part of a package tour, does not play a role in your compensation claim. For the claim for compensation, it is also crucial that the reasons for the cancellation can be traced back to the airline. If a flight is cancelled for reasons beyond the airline’s control, e.g. severe weather, air traffic controllers’ strikes, airport and airspace closures or travel restrictions due to Corona, it does not have to pay compensation to passengers.

When can I get a ticket refund from TAP Air Portugal for a flight cancellation?

If your flight is cancelled without TAP Air Portugal at fault, you are not entitled to compensation under EU passenger law. However, you have the right to alternative transport to your destination or to be rebooked to a later date. If you do not wish to do this, or if there is no possibility of obtaining alternative transportation, TAP Air Portugal will have to refund you the original ticket price paid. By the way: The ticket price to be refunded includes the entire cost of the flight. So, if you paid extra money for seat reservations, baggage, or meals, the airline will have to pay you back that cost as well. TAP Air Portugal can also offer you a voucher as a refund. However, you can insist on the payment of the ticket costs. The airline must then comply with this request in a timely manner. Once you have accepted the voucher, you can no longer demand payment of the ticket price afterwards.

When can I claim compensation and a ticket refund in the event of a flight cancellation?

If the airline is responsible for the flight cancellation itself and has informed you of the cancellation less than 14 days before the scheduled departure and has not offered a replacement flight, you can claim both compensation and a ticket refund from the airline.

How much compensation can I get from TAP Air Portugal?

The amount of compensation is calculated according to the flight route. How much you paid for the flight is unimportant for the compensation amount.

  • Short-haul (less than 1,500 kilometres): You are entitled to compensation of €250 from TAP Air Portugal under EU law

How long can I claim compensation or a ticket refund for my flight?

You can claim compensation and ticket refund in UK up to 6 years after the flight. The deadline is calculated at the end of the year. So, for example, if you had a flight cancellation with TAP Air Portugal in the summer of 2024, you can file compensation claims and ticket refund claims until the end of 2030.

What rights do I have if my TAP Air Portugal flight is overbooked?

Unfortunately, it regularly happens that airlines overbook flights, i.e. sell more tickets than there are seats on board. In this way, airlines want to make the most of their flights. If you learn at the airport that your flight is overbooked and therefore you cannot fly as planned, you are entitled to an alternative flight or compensation or ticket refund. What am I entitled to if the departure is postponed to the next day?

If your flight has to be postponed to the next day at short notice, the airline is obliged to arrange accommodation for you. This means that the airline must arrange an overnight stay in a hotel and a return trip to the airport for you. In addition, it must bear the costs for this. It does not matter why the flight has been postponed to the next flight. The airline is obliged to take care of your accommodation. If the airline does not proactively contact you and offer accommodation, you should approach the TAP Air Portugal staff directly on site and insist on your rights. In the event that you have to organize the hotel rooms and transfer yourself, please clarify that the airline will cover the costs afterwards. It is best to have the confirmation given in writing.

What are the requirements for TAP Portugal Flight Delay or Cancellation Compensation?
